Agreement to Terms

By accessing or using InsightEngine ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Description of Service

InsightEngine provides software tools to help contractors manage bids, pricing, leads, and business operations. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

Account Registration

To use the Service, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

You are responsible for all activity under your account.

Subscription and Payment

Billing

Subscriptions are billed monthly or annually in advance. By subscribing, you authorize us to charge your payment method for the subscription fee.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Cancellations take effect at the end of the current billing period. No refunds for partial months.

We offer a 90-day money-back guarantee. If you're not satisfied, contact us within 90 days of your initial purchase for a full refund.

Acceptable Use

You agree not to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malicious code or viruses
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Use the Service to spam, harass, or harm others
  • Resell or redistribute the Service without authorization

Your Data

You retain ownership of all data you enter into the Service. You grant us a license to use, store, and process your data solely to provide the Service. We will not share your individual data without your consent, except as required by law.

You are responsible for backing up your data. We provide export tools, but we recommend maintaining your own backups.

Intellectual Property

The Service, including all content, features, and functionality, is owned by InsightEngine and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Disclaimers and Limitations

Service Availability

The Service is provided "as is" and "as available." We do not guarantee uninterrupted, secure, or error-free operation. We may perform maintenance that temporarily affects availability.

Limitation of Liability

To the maximum extent permitted by law, InsightEngine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from your use of the Service.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold InsightEngine harmless from any claims, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Service immediately ceases.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Travis County, Texas.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
